1. Introduction and Agreement
1.1 These Terms and Conditions ("Terms") apply to the use of the Ma Belle Queen website and the purchase of products offered through our website (the "Site").
1.2 By visiting our website, purchasing Products, or agreeing to these Terms, you also agree to our Privacy Policy, Shipping Policy, and Refund Policy.
1.3 If you do not agree to these Terms and Conditions, you must not use the Site or purchase any Products.
2. Acceptance and Eligibility
2.1 You represent and warrant that you are a natural person, are at least 18 years old, and have the legal capacity to enter into a binding contract with us.
2.2 We reserve the right to refuse you access to our Site if we consider such refusal necessary or appropriate.
2.3 You confirm that you will use the Website to purchase Products solely for your own personal, non-commercial use.
3. Pricing and Taxes
3.1 The prices of the Products shown on our website include delivery charges (Free Standard Shipping).
3.2 Duties, Taxes, and Import Charges: All prices are exclusive of any fees, taxes, duties, levies, or other governmental charges related to importation ("duty unpaid and untaxed").
3.3 Customer Responsibility: Since goods are shipped from a non-EU country (China), the buyer is the "importer of record" and is solely responsible for the payment of customs duties, import VAT, or any other governmental charges upon import. You must comply fully with all laws and regulations of the importing country.
3.4 Pricing Errors: We will do our best to ensure all prices are correct. If a pricing error occurs, we will notify you immediately and give you the option to reconfirm or cancel your order for a full refund. We are not obliged to fulfil an Order if the price is incorrect.
4. Placing and Accepting Orders
4.1 All orders are subject to stock availability. A contract is only concluded when we issue an Order Confirmation email.
4.2 If your order consists of more than one Product, the Products may be delivered in separate shipments.
4.3 We reserve the right to refuse or reject any order placed by you at any time. If we cancel your order after receiving payment, the payment will be refunded to you in full.
5. Payment
5.1 You can pay for the Products using any of the payment intermediaries listed on our website.
5.2 You confirm that the method of payment used is yours and that you have sufficient funds or credit capacity to pay for the order.
5.3 We may use payment intermediaries, and you agree that we may pass necessary information to them. We are not responsible for payment failures or problems caused by these intermediaries.
6. Delivery
6.1 We will endeavor to deliver your order to the delivery address provided at checkout.
6.2 Delivery Timeline: Goods will be dispatched within 1 to 3 business days of confirmed payment. The total estimated delivery time is 4 to 10 business days, as detailed in our Shipping Policy.
6.3 We are not liable for any loss, liability, costs, damages, or expenses arising from any delay in delivery outside of our stated windows, to the extent permitted by law.
6.4 All risk in the product passes to you upon delivery to the delivery address.
6.5 If delivery or collection is delayed by your unreasonable refusal to accept delivery, we may charge you for reasonable fees incurred in returning the order to the sender.
7. Order Cancellation and Modification
7.1 Cancellation Window: You can cancel or amend your order within 24 hours of purchase by sending us an email to Contact@chickvogue.com.
7.2 Post-24 Hours: After the 24-hour window, your order may have already been processed and cannot be canceled. You must wait until you receive the goods and then initiate a return in accordance with our Refund Policy.
8. Returns, Exchanges, and Refunds
8.1 Our separate Refund and Return Policy forms an integral part of these Terms and sets out the full details on returns and exchanges.
8.2 The cooling-off period is 30 days from the date of delivery.
8.3 Return Costs: The customer is responsible for return costs for non-defective items (buyer's remorse). We cover return costs for defective or incorrect items.
8.4 Condition of Return: Products must be returned in the same condition in which you received them: unused, with labels intact, and in the original packaging.
9. Defective Products
9.1 All product descriptions, information and materials on the Website are provided "as is." Illustrations may differ slightly from the actual product.
9.2 If the product is faulty, you must contact us via email, providing photographic evidence.
9.3 Our sole obligation for defective Products is, at our discretion, to replace the Product or refund the purchase price (including the cost of returning the defective Product).
10. Permitted Use and Prohibited Actions
10.1 You may not use our website in any way that causes or may cause damage, impairment of performance, or unavailability.

13.3 Our liability arising directly or indirectly from these Terms shall be limited and capped at the greater of US$1,000 or five times the price you paid for the Products giving rise to the liability.
13.4 The exclusions and limitations of liability shall not affect our liability for death or personal injury resulting from our negligence or for fraud.
13.5 You agree to indemnify and hold us fully harmless against all claims, costs, and losses arising out of your material breach of these Terms.
14. Governing Law and Jurisdiction
14.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of NM, U.S.A.
14.2 You and we irrevocably agree that the courts of NM, U.S.A shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).
